The course provides participants with a high-level overview of the role and responsibilities of the Engineer’s Representative as outlined within NZS 3910 and NZS 3916.
The course is interactive with the learners, and the focus is not only on key aspects of the role but also the soft skills that are needed to be successful in the role. It will also touch upon the role of the Engineer to the Contract and their relationship with the Engineer’s Representative.
In the current construction market and the increasing use of NZS 3910 and NZS 3916 by the industry, it is even more critical to have sufficient individuals that can take on this crucial role to enable successful delivery of the contract, for both the Principal and Contractor.
By the end of the course, you will be able to:
- Understand the difference between the Engineer’s Representative (ER) role & Engineer to the Contract (ETC)
- Focus on the key areas of the ER role that will assist the ETC that has strict contractual requirements to follow within NZS 3910 and NZS 3916
- Have a high-level understanding of the key changes from NZS3910:2013 to the new NZS3910:2023
- An understanding of the ER soft skills required for successful delivery of the contract
- Hear of real life situations / lessons learnt and the consequences of not properly carrying out the Engineer’s Representative tasks in relation to the conditions of contract
- Understand the H&S requirements as it applies to the ER within NZS 391X contract and also H&S legislation
- Where to go to look and find your key clauses within NZS 391X to assist in administering the contract.

About the presenter
David Chung
David Chung is recognised as a specialist in the preparation of contracts, experienced in procurement and construction contracts and the role of Engineer to the Contract. He has worked throughout New Zealand, Fiji, India, Hong Kong and the United Kingdom.
David's role within Egis is Principal - Procurement & Contracts, meaning he has expertise and extensive hands-on contract management and procurement experience with contracts of all sizes and types, and works for a variety of Government, Local Councils and commercial clients. He's a member of Engineering NZ's Society of Construction Contract Practitioners (SCCP) Panel, as well as the Kainga Ora's Engineer to the Contract panel.
